Mediation

What is mediation?
Conflicts happen wherever people are in contact. That is a condition in both professional and private existence. Numerous conflicts reach an impasse and appear at the first glance to be insoluble. The parties to conflict part without reconciliation or they chose to leave the conflict to neutrals e.g. courts of law or supervisors. That kind of resolution can be a lengthily or strain process and even the ”winner” is frequently not really satisfied. A number of aspects neither the court nor the supervisor can/will deal with and the relation to the opponent deteriorate than ever imagined. When the conflict is left to the neutral, the supervisor or the court, the outcome is uncertain and the solution is ordered.

Mediation is a fit alternative.
Mediation is a means assisting the parties to conflict by negotiation to help the parties finding an acceptable solution. A neutral and trained Mediator presides over the negotiations. The purpose of the mediator presiding over the negotiations is simply to increase the likelihood that the parties will reach a solution.

A mediator does not offer suggestions to solutions and do not evaluate suggestions or agreements. Mediator’s task is to facilitate that the negotiations are carried out in a manner so constructive that the parties reach a solution of their own. Mediation has been used in e.g. the US, Australia and a number of European countries for years and has become a popular means for solving both professional and private conflicts.
Basic principles for mediation.

  1. Mediation is always voluntary for the parties and they can at any time leave the negotiations.
  2. In mediation confidentiality is respected. That applies for the parties and the mediator.
  3. Mediator is neutral and impartial and do not offer solutions to the conflict.
  4. Mediator does not offer any legal evaluation of the conflict.
  5. Mediator presides over the negotiations.
